DESCRIPTION:
- The Town Prosecutor prosecutes violations of the Town Code before the Town’s Justice Court.
- Duties and Responsibilities: Represent the People of the State of New York in the prosecution of all town code violations, including but not limited to: scheduling and coordinating officer appearances; reviewing all town code cases presented for purposes of prosecution; determining technical compliance with town code and other state statutes; writing complaints; drafting, filing and arguing motions when appropriate; prosecuting defendants at trials; and making recommendations to the Court for alternatives to prosecution where appropriate. Timely pursuit of disposition of town code cases in advance of Court date.
- The Yorktown Town Justice Court hears town code violations twice a month, on the first Tuesday and third Thursday of every month at 6 pm. Conferences may begin earlier. Venue is occasionally changed to another town’s justice court. Each court date requires approximately two hours of time in court plus one hour of preparation; this is not a guarantee of such hours; the total number of hours will vary from month to month.
