“You Be the Judge – The Sequel”

“You Be the Judge – The Sequel”
A mock trial on custody litigation in domestic violence cases

Join us for the sequel to the last successful continuing legal education program, “You be the Judge,”
featuring Ramona and Steven, who were previously embroiled in litigation before the Family Court. Fast
forward several years, the parties have reunited and married. Unfortunately, old patterns have resurfaced
and the marriage quickly falls apart. After a physical confrontation with her husband, fearful for her
safety and the safety of the children, Ramona seeks the assistance of a local victim assistance program,
which helps her file petitions for custody of the children and an Order of Protection. The case is
transferred to the Integrated Domestic Violence Part and the trial begins. A panel composed of the
parties, attorneys for the parties, attorney for the children, prosecutor from the Rockland County District
Attorney’s Office, a Forensic Evaluator and the Court will engage in a mock trial and discussion. Issues
that confront the Family Law and Matrimonial Law Practitioner in their representation of clients will be
examined, including the admissibility of electronic evidence; the admissibility and use of forensic reports
and cross-examination of a Forensic Evaluator; and the prosecution and defense of family offenses and
their relationship to pending criminal matters.
