The complexities created by technology in litigation, particularly in the context of eDiscovery, raise the question about the measures a lawyer should take to satisfy the duty of competence and adequately represent the interests of clients in discovery. This program will explore these issues and spotlight ethical standards and practical steps counsel should consider to help clients meet their discovery obligations.

Topics covered include:

  • Developing a better grasp of the new sources of electronically stored information subject to preservation and production in litigation
  • Gaining an understanding regarding advanced search methodologies and the role of analytics in eDiscovery
  • Safeguarding client confidences, attorney-client privileged materials, and attorney work product
