This introductory course provides practitioners with a practical framework for filing habeas corpus petitions on behalf of detained noncitizens in the federal district courts. The program begins with an overview of the principal federal court immigration remedies — including APA/mandamus actions, habeas corpus, and petitions for review — and explains when each is appropriate. Participants will examine the constitutional and due process foundations of habeas relief, jurisdictional and venue requirements (including the immediate custodian rule under Rumsfeld v. Padilla), and the essential elements of a habeas petition.

The course then addresses specific factual postures that may give rise to a habeas claim, including entry without inspection, bond appeals, “arriving alien” status, post-removal-order detention under Zadvydas v. Davis, OSUP revocations, and very old removal orders. Practitioners will also learn strategies for handling cases involving transfers from the Second Circuit to the Fifth Circuit. Practical guidance on intake, identifying the right legal theory, and navigating New York-area detention facilities is included throughout.
